St. Louis Criminal Defense Attorney W. Scott Rose recently won a dismissal of a felony drug case in Franklin County, Missouri, based on the Franklin County Sheriff’s Department’s use of a machine called the TruNarc Analyzer.
Rose Legal Services’ client (defendant) drove the wrong way around a traffic circle, crashed her automobile into a tree, and left the scene of the accident without reporting it to law enforcement. She was later found at her home where law enforcement officers observed a strong odor of alcohol, thick and slurred speech, glassy bloodshot eyes, difficulty maintaining balance, and confusion. She admitted to having “some drinks earlier.” She was charged with Driving While Intoxicated and faced a one-year suspension of her driver’s license for refusing to submit to a chemical test of her breath. A court found no probable cause for the arrest and ordered her license reinstated, and the criminal charge was later dropped.
A defendant and Rose Legal Services’ client was seen on surveillance video entering a local business and removing items after hours. The State charged him with Burglary 2nd Degree and Felony Stealing. After a hearing, the Court dismissed the case for lack of probable cause.
During a pat-down search for weapons, law enforcement discovered a “baseball-sized” bulge in a Rose Legal Services client’s front pants pocket that was later determined to be marijuana and cocaine. After an evidentiary hearing, and a solid defense by W. Scott Rose, the search was found to be unconstitutional, and all charges were dismissed.
W. Scott Rose’s client, a college student who worked during the summer at a local gym was arrested for allegedly stealing a gym member’s $10,000 diamond engagement ring. She had left the ring in the group exercise area, and the defendant could be seen on surveillance video cleaning and bending over in the area of the engagement ring. After a hearing, the Court dismissed the case for lack of probable cause.
Rose Legal Services’ client was charged with two counts of Statutory Sodomy 1st Degree and one count of Child Molestation 1st Degree. The accuser was an ex-girlfriend’s 12-year-old daughter, and if convicted, he faced a minimum of 20 years in prison without probation or parole. After a three-day jury trial, the jury deadlocked 10-2 to acquit. The State later dropped all charges.
