BURGLARY CHARGES IN ST. LOUIS

Burglary is a term for the unauthorized entry into a structure with the intent to commit a crime inside. No victims need to be present, no goods have to be stolen, and no forced entry is required to be charged with burglary; however, the presence of any of those elements will likely result in a higher burglary charge or additional criminal charges.

Burglary 1st Degree

  • Caused or threatened immediate physical injury to any person who was not a participant in the crime.

Theft in the first degree is considered a Class B Felony. Punishable by a minimum of (5) five to a maximum of (15) fifteen years in prison.

Burglary 2nd Degree

To convict a person of Burglary 2nd Degree, the State must prove beyond a reasonable doubt that the defendant:

  • Knowingly entered unlawfully or knowingly remained unlawfully, in a building or inhabitable structure, to commit a crime therein.

Burglary 2nd Degree is considered a Class D Felony punishable by up to (7) years in prison and fines of up to $10,000.
