• The expungement would serve the public interest and the interests of justice
  

However, some types of offenses are never eligible for expungement under this law. These include:

• Class A felonies
  
• Dangerous felonies, as defined by Missouri law
• Any offense requiring sex offender registration
  
• Felony assault, domestic assault, or kidnapping
  
• Crimes involving death
  
• Many firearm, fraud, and public corruption offenses
• Most intoxication-related traffic or boating offenses, including DUI/DWI^[b], especially with a commercial driver’s license

The law also places lifetime limits on how many expungements someone can receive: no more than one felony and no more than two misdemeanors or municipal offenses with jail time.

If your case doesn’t qualify under § 610.140, other legal options may still be available, including expungement for arrest records, mistaken identity, or marijuana-related convictions under separate procedures. First-Offense DWI’s are also eligible for expungements under a different statute, in certain circumstances.
